Can You Install an EV Charger in Your Housing Society? Know Your Rights, Society Rules and Safety Requirements
Electric vehicles (EVs) are becoming increasingly popular in India. Rising petrol and diesel prices, lower running costs and growing concern about pollution are encouraging more people to switch to electric cars and two-wheelers.
But before buying an EV, apartment residents often have one major concern: Can I install an EV charger in my society parking space?
The answer is generally yes, if you have an allotted parking space and follow the required safety and electricity procedures. However, housing societies can impose reasonable conditions, especially when electrical capacity, fire safety or building infrastructure is involved.
Here is what EV owners and prospective buyers should know.
Can an EV Charger Be Installed in Society Parking?
For residents with an allotted parking space, installing an EV charging point is possible. The Ministry of Power has issued guidelines encouraging EV charging infrastructure and providing a framework for charging facilities in residential areas.
A society should not simply reject an EV charging request without considering the applicable rules and technical requirements.
In practice, however, residents may need to submit a written request to the society management and follow its procedure for electrical work.
Depending on the building and electricity arrangement, charging can potentially be connected through the resident's electricity meter or through a separate meter or approved electrical connection.
The important point is that the installation must be safe, technically suitable and properly approved.
Why Are Housing Societies Sometimes Concerned?
The biggest concerns raised by housing societies are usually related to electrical load and fire safety.
An EV charger can draw a significant amount of electricity, particularly when charging a car. In an older building with outdated wiring or limited electrical capacity, adding several high-power chargers could put additional pressure on the electrical system.
Basement parking can also raise concerns about fire safety and emergency access.
However, these concerns do not automatically mean that every EV charging request can be rejected. The society should consider the actual electrical capacity, charger specifications, wiring arrangement and safety measures involved.
A technically sound installation can significantly reduce the risks associated with EV charging.
A Real-Life Dispute Over an EV Charger
The difficulties faced by some EV owners show why this issue has become important.
One reported case involved Rakshit Somani, who purchased a Mercedes-Benz EQB costing around ₹1 crore. His housing society initially refused to provide a No Objection Certificate (NOC) for installing a charger in his parking area, citing safety concerns.
The dispute continued for around two and a half years.
According to reports, Somani argued that he already had a Mercedes-Benz-approved charging system, appropriate wiring and the necessary electricity-related approval. Without a home charger, he had to depend on public charging stations.
That made charging considerably more expensive. He reportedly estimated the cost at around ₹3.5–₹4 per kilometre using public charging, compared with approximately ₹1.5 per kilometre when charging at home.
The dispute ultimately resulted in permission for the charger, highlighting an important issue for apartment residents: EV owners should have a practical way to charge their vehicles at their homes when the required technical and safety conditions can be met.
When Can a Society Raise an Objection?
Having a right to request EV charging does not mean a resident can install any charger anywhere without following rules.
A society can legitimately raise concerns if the proposed installation creates a genuine technical or safety problem.
For example, concerns may arise when:
The building's electrical system cannot safely handle the additional load.
Existing wiring is old, damaged or inadequate.
The proposed charger is unsuitable for the electrical connection.
Proper circuit protection has not been provided.
Installation could interfere with fire-safety systems or emergency access.
Multiple chargers could overload a common electrical connection.
The proposed installation does not comply with applicable electricity or building-safety requirements.
In such cases, the solution should ideally be to address the technical problem, rather than simply rejecting EV charging altogether.
What Should an EV Owner Do?
If you want to install an EV charger in your society parking area, start by making a written application to the society management.
Mention the vehicle, charger specifications, proposed location and electrical requirements. If possible, include details of the charger manufacturer and installation plan.
You should also clarify how electricity consumption will be measured and billed.
1. Consider a Separate Meter
A separate electricity meter or approved connection can make billing much easier.
It also helps clearly identify how much electricity is being consumed for EV charging, rather than creating confusion over the society's common electricity expenses.
2. Use an Approved Charger
Do not install a cheap or uncertified charger simply because it costs less.
Use a charger recommended or approved by the vehicle manufacturer or a reputable charging-equipment provider. The installation should also be carried out by a qualified electrician.
3. Use Proper Wiring and Protection
EV charging involves continuous electrical load, so the wiring and protective equipment need to be appropriate for the charger's power requirements.
Suitable MCBs, RCCBs/RCBOs and other required protection devices should be used according to the electrical design.
The exact equipment should be determined by a qualified electrical professional rather than by guesswork.
4. Avoid Overloading
If several residents want EV chargers, the society may need to evaluate the building's overall electrical capacity.
Instead of allowing everyone to charge at maximum power simultaneously, the society could consider appropriate load management or other technical solutions.
This can make EV charging safer while allowing more residents to use the facility.
Who Pays for the Installation?
In many cases, the individual EV owner is expected to pay for the cost of installing the charger, including wiring, electrical work, protection equipment and any other infrastructure specifically required for their vehicle.
The exact arrangement can depend on the society's rules, electricity connection and applicable local regulations.
Residents should therefore ask for a clear written estimate before beginning the work.
What If the Society Refuses?
If a society refuses an EV charging request, residents should first ask for the reason in writing.
A genuine electrical or safety concern can often be resolved through a revised installation plan, additional protection or a separate electrical connection.
If the refusal appears arbitrary, the resident can seek advice from the relevant electricity authority, housing-society authority or an appropriate legal professional. The exact process can vary by state and the legal status of the housing society.
It is also important not to install the charger secretly or bypass the society's electrical system. Doing so could create genuine safety problems and weaken the resident's position in any dispute.

Buying an EV while living in an apartment does not necessarily mean that you have to depend entirely on public charging stations.
If you have an allotted parking space, you can generally seek permission to install an EV charging point, provided the installation meets applicable electricity, building and fire-safety requirements.
At the same time, societies have a responsibility to protect the building and its residents. They can raise legitimate concerns about electrical capacity, wiring, fire safety and overloading.
The best approach is therefore not a conflict between "EV owner vs society", but a properly planned installation that protects both.

With proper electrical planning, certified equipment, appropriate protection and transparent billing, safe EV charging in residential societies can become a practical part of everyday apartment living.
